There is created a Yap State Health
Services Board, hereinafter referred to as the Board.

The purpose of this chapter is to
provide for a means to achieve greater participation of the people of the
State in the planning, delivery and evaluation of health care services, to
facilitate cooperation between providers and consumers of health care
services, and to promote the advancement of the health of the people of
the State.

Cross-reference: The constitutional provision on health is found in Yap Const., Art. XII, Sect. 1. That section states: "The State Government shall provide for the protection and promotion of the public health, which may include the traditional practice of medicine".
The Board shall consist of five
members as follows:
(a) Chief of Planning; and
(b) Four members appointed by the Governor.

Except for the Chief of Planning who
shall serve on the Board by virtue of his position, the other members
appointed pursuant to subsection (b) of section 103 shall serve at the
pleasure of the Governor.

Members of the Board who are
officials and employees of the State Government shall be entitled to
administrative leave while on the business of the Board. Members of
the Board who do not receive regular salaries from the State Government
while on the business of the Board shall receive $15.00 per day while on
such business. Members shall also be entitled to their necessary
expenses incurred in the discharge of their duties to the extent funds are
made available.

The Board shall hold its first
meeting within 30 days of the effective date of this act. At the
first meeting, the Board shall elect from among its members a Chairman who
shall serve for a period of one year. No member who has been elected
Chairman shall again be eligible to be elected Chairman until one full
term has intervened. Board meetings shall be held at least once
every three months and at such other times as may be designated by the
Chairman. A quorum of the Board shall consist of three voting
members. The Board may establish by-laws as it deems necessary and
consistent with this chapter.

The Board shall have the following
powers and responsibilities:
(a) To consult with the Director of Health Services and review plans, programs, projects and policies of the State Department of Health Services, and to recommend changes or alternatives consistent with the purpose of this chapter;
(b) To review budgets and budget requests and proposals for State Department of Health Services, including all pertaining to United States Congress grant funds, and to recommend changes or alternatives consistent with the purpose of this chapter;
(c) To promote greater understanding and cooperation between providers and consumers of health care services, and to promote public health education to accomplish the same;
(d) To conduct public hearings and serve as a liaison between the State Department of Health Services and concerned persons and organizations;
(e) To submit findings and recommendations to the Governor, Legislature, State Department of Health Services, the Council of Pilung and the Council of Tamol, including evaluation of health care services, upon its own initiative or upon request; and
(f)
To perform such other functions consistent with the purpose of this
chapter.
