This chapter shall be known and may
be cited as the "State Budget Act of 1979".

The purpose of this chapter is to
implement Section 7 of Article IX of the Constitution of the State of Yap
requiring the Governor to submit an annual budget to the
Legislature.

The budget shall be submitted in a form, at a time, and for fiscal years prescribed by law. The Governor shall also submit bills to provide for proposed expenditures and for any recommended additional revenues at a time prescribed by law."
(a) The Governor shall submit to the Legislature not later than the first Monday of May of each year an annual budget bill which shall contain:
(1) A statement showing the estimated condition of the State Government Treasury at the close of the fiscal year in progress;
(2) A statement of the estimated condition of the Treasury at the close of the ensuing fiscal year if the financial proposals contained in the budget are adopted;
(3) Actual expenditures for the last completed fiscal year;
(4) Estimated expenditures for the fiscal year in progress;
(5)
Proposed appropriations for the ensuing fiscal year;
(6) A functional statement of proposed appropriations and expenditures; and
(7) Estimated revenues and receipts for the ensuing fiscal year on the basis of laws existing at the time the annual budget bill is transmitted.
(b) All government budget requests for funding by the Legislature shall be submitted to the Governor for review and inclusion in the annual budget bill for submission to the Legislature.

The annual budget bill shall identify
the source of revenues and receipts expended, proposed for expenditure,
and proposed for appropriation and those estimated to be available during
the same fiscal year as the budget bill. Sources shall include tax
and license revenues of the State, grants and funds from other governments
including, but are not limited to, United States grants and federal
program funds, appropriations and allocations by the Congress of the
Federated States of Micronesia, and receipts from government services,
fines and charges.

Expenditures in the annual budget
bill shall be listed according to department, office, agency, program, and
project.

(a) Any reprogramming of proposed expenditures in the form approved by the Legislature, shall require the approval of the Legislature, except as provided in subsection (c) of this section.
(b) Nothing in this section shall be construed to be inconsistent with the authority of the granting government or agency thereof over grants or funds received therefrom by the State.
(c) Notwithstanding the provisions of this section, reprogramming of funds in the form approved by the Legislature may be authorized by the Governor if:
(1) A financial emergency exists which requires the reprogramming of funds, or when reprogramming of funds is necessary in order to prevent anticipated budget deficiencies; and
(2) The reprogramming of funds shall be within the operation budget of a department, office or agency.
