       §101.  Code established.
       There shall be a Yap State Code which shall contain, except for appropriation measures, all Yap State Laws and all Yap State Orders effective throughout the State of Yap.

Commission Comment:  The work of the Yap State Code Commission to complete and publish the Yap State Code was carried out pursuant to the provisions of Yap State Law No. 1-87.

       §102.  Numbering of code sections.
       The numbering of all sections of the Yap State Code shall be official, and code sections may be cited thus:          YSC       .  The labeling of all divisions, chapters, subchapters, parts, sections, subsections, and paragraphs and the numbering of all divisions, chapters, subchapters, parts, sections, subsections, and paragraphs shall be explanatory only.

Commission Comment:   The citation of laws included in the titles of this Code is as follows:  first, title number in arabic numerals; second, "YSC"; and third, section number in arabic numerals.  Example:  The citation of section 102, "Numbering of code sections.", of Title 1, "General Provisions" would appear as "1 YSC 102 ".

       §103.  Definitions.
       Except as otherwise specifically defined in this Code, the terms below will be defined as follows:

     (a)  "Attorney General" means the Attorney General of the State of Yap.

     (b)  "Chief Clerk" means the Chief Clerk of the Legislature of the State of Yap.

     (c)  "Chief Justice" means the Chief Justice of the State Court of the State of Yap.

     (d)  "Child" includes child by adoption.

     (e)  "Clerk of Court" means the Clerk of Court of the State Court of the State of Yap.

     (f)  "Code" means the Yap State Code.

     (g)  "Constitution" means the Constitution of the State of Yap.

     (h)  "Election Commissioner" means the Election Commissioner of the State of Yap.

     (i)  "Executor" includes administrator, and "administrator" includes executor.

     (j)  "General Fund" means the General Fund of the State of Yap.

     (k)  "Governor" means the duly elected Governor of the State of Yap.

     (l)  "Legislature" means the Legislature of the State of Yap.

     (m)  "Lieutenant Governor" means the duly elected Lieutenant Governor of the State of Yap.

     (n)  "Oath" includes affirmation, and "swear" includes affirmation.

     (o)  "Outer Islands" include the following islands and small atolls:  Ulithi Atoll, (Asor, Falalap, Fassarai, Lothou, and Mogmog Islands), Fais, Nguluw Atoll, Sorol Atoll, Woleai Atoll (Falalap, Falalus, Mariyong, Paliau, Sileap, Tohoilap, and Woteggai Islands), Eurapik Atoll, Faraulep Atoll, Ifalik Atoll, Satawal, Lamotrek Atoll, and Elato Atoll, and such other Islands and atolls as are not included within the Yap Islands Proper.

     (p)  "Person" means individual, corporation, government or governmental division or agency, business trust, estate, trust, partnership or association, or any other legal entity.

     (q)  "Preceding" and "following" when used by way of reference to a chapter or other part of a statute means the next preceding or next following chapter or other part.

     (r)  "Property" means real and personal property.

     (s)  "Public Auditor" means the Public Auditor of the State of Yap.

     (t)  "Rules" includes regulation.

     (u)  "Speaker" means the duly elected Speaker of the Legislature.

     (v)  "State Court" means the State Court of the State of Yap.

     (w)  "Treasurer" means the Treasurer of the State of Yap.

     (x)  "Treasury" means the Treasury of the State of Yap.

     (y)  "Vice-Speaker" means the duly elected Vice-Speaker of the Legislature.

     (z)  "Written" or "in writing" includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures.

     (aa)  "Yap Islands" or "Yap Islands Proper" means those islands comprising the following municipalities:  Dalipebinaw, Fanif, Gagil, Gilman, Kanifay, Map, Rull, Rumung, Tomil, and Weloy.

     (bb)  "Yap State" , "State of Yap" or "State" means the State as defined by the Constitution of the Federated States of Micronesia, Article I, Section 2.

Cross-reference:  Article I, Section 2 of the Constitution of the Federated States of Micronesia states:  "Each state is comprised of the islands of each District as defined by laws in effect immediately prior to the effective date of this Constitution. A marine boundary between adjacent states is determined by law, applying the principle of equidistance. State boundaries may be changed by Congress with the consent of the state legislatures involved.

       §104.  Registry of Laws.
       The Governor shall keep an official Registry of Laws.  The Registry of Laws shall contain the original of each Yap State Law as signed by the Governor or enacted into law without his signature.
