Petition by widow of intestate decedent to be appointed administratrix of decedent. Decedent died leaving heirs in the First Class and also in the Second Class under the Ponape Intestacy Law. The Ponape State Court, EDWEL H. SANTOS, Chief Justice, granting the petition, held that the petitioner as administratrix shall apply the proceeds of the assets of the decedent for the benefit and welfare of the First Class heirs of the decedent and shall apply same for the settlement of any lawful debts owing by the decedent

Administration - Duty of administratrix.
The administratrix of the estate of an intestate decedent shall apply the proceeds of the assets of the decedent for the benefit and welfare of the First Class heirs of the decedent, and shall apply same for the settlement of any lawful debts owing by the decedent.

This is an action for the administration of the estate of Robert Carlos, deceased, brought by petitioner Fatima A. Carlos, widow of the decedent.
FACTS
1. Robert Carlos and the petitioner were married on or about the year 1972 in the Catholic Church in Kolonia.
2. During the course of the marriage, five children were born to the petitioner and the decedent. They are:
a. Patrick Abraham son
b. Randy Abraham son
c. Gloria Carlos daughter
d. Deresa Carlos daughter
e. Alfred Carlos son
The decedent, Robert Carlos, died on or about June 10,1984. The decedent died leaving a number of heirs in the First Class as enumerated above and other heirs in the Second Class, pursuant

to the classification of heirs as provided in the Ponape State Intestacy Law. The decedent died without a will.
Accordingly, it is ORDERED as follows:
1. Petitioner Fatima A. Carlos is hereby appointed administratrix of the decedent's estate.
2. As administratrix, the petitioner is authorized and empowered to cash the checks made payable to the order of the decedent as mentioned in this Order and all other checks or commercial documents that may hereinafter be made pay able to the order of the decedent, or the estate.
3. The administratrix is authorized and empowered to effect any change in the ownership of the Certificate of the stock at the KCCA registered in the name of the decedent.
4. The petitioner shall apply the proceeds of these assets for the benefit and welfare of the First Class heirs of the decedent and shall apply same for the settlement of any lawful debts owing by the decedent.
