Petition for divorce in respect of which the parties filed a stipulated agreement for judgment. The Trial Division of the Pohnpei Supreme Court, EDWEL H. SANTOS, Chief Justice, granted the petition and approved the marital settlement agreement.

Where parties to an action for dissolution of their marriage execute a marital settlement agreement the Court may give effect to such agreement.

Hearing on respondent's motion to dismiss petition for divorce heretofore filed by petitioner was scheduled to be held this 8th day of March, 1985. Respondent, however, filed on March 7, 1985, a notice of withdrawal of said motion to dismiss, and on the scheduled hearing, the parties were before me with a stipulated agreement for judgment which was received and filed. The Court heard representations by counsel, examined the said stipulated agreement for judgment and approved the same.

Accordingly it is Ordered, Adjudged and Decreed as follows:
1. That a cause for divorce from the bonds of marriage has been satisfied, and petitioner Merins H. Nix, be, and is hereby granted a decree of absolute divorce from the respondent, Steven B. Nix, and the bonds of marriage between them be, and the same are hereby dissolved.
2. The marital settlement agreement executed by petitioner and respondent and attached hereto, is approved by the Court,and the same is incorporated and merged in this judgment, and the parties are ordered to comply with the terms and provisions of said agreement.
It is So Ordered this 8th day of March 1985.
