This master was specially set for hearing on May 16, 1997 at 4:00 p.m. Appearing on behalf of Petitioner Tafunsak Municipal Council was Delson Ehmes. Ronald Moroni represented the Respondent, Mayor Eugene Palsis.
Based upon the information submitted before this Court, and the Court having considered the submissions by counsel, arguments of counsel, the file in this matter and the interests of justice, hereby rules as follows:
Respondent's Motion for Stay of Order Pending Appeal is denied. Respondent's Motion is denied on the following grounds:
This Court had jurisdiction to accept the Petition submitted by the Tafunsak Municipal Council and to enter the Order Establishing the Conduct of a Special Removal Election, pursuant to its powers vested by the Kosrae State Constitution and the Kosrae State Code.
The notice and procedure employed for the establishing and noticing the Special Removal Election was consistent with the provisions established in the Tafunsak Municipal Constitution, Article VIII.
The Respondent has not carried his burden showing that Respondent will suffer irreparable injury from the conduct of the Special Removal Election.

This Court’s Order Establishing the Conduct of a Special Removal Election remains effective and the Special Removal Election of the Mayor of Tafunsak shall be held on May 19, 1997.
