     § 1101.  Creation of Board.
     There is hereby created a Truk Chuuk State Health Services Advisory Board, hereinafter referred to as the Board.

Cross-reference:  The constitutional provisions on health are found in Art. X, Sections 6 and 7 of the Chuuk State Constitution.  Sections 6 and 7 state as follows:

     Section 6.  The State Government shall provide for the protection and promotion of health, and shall ensure, within the limits of its resources, that no person is discriminated against in the distribution of medical care, or is refused medical care because of that person's inability to pay.
     Section 7.  The State Government shall provide for the establishment and administration of a comprehensive system of medical or health insurance which is mandatory for all employed residents of the State of Chuuk while present in the State.  All revenues received under this system of medical or health insurance, and all other revenues received by the Health Department as payment for medicine and medical services, shall be separated from any general fund established by the Legislature and used only for medical purposes.

     § 1102.  Purpose.
     The purpose of this act Chapter is to provide for a means to achieve greater participation of the people of Truk Chuuk State in the planning, delivery, and evaluation of health care services to facilitate cooperation between providers and consumers of health care services, and to promote the advancement of the health of the people Truk Chuuk State.

     § 1103.  Membership.
     The board shall consist of eight members as follows:

     (1)  The Chairman of the Legislature Senate Committee on Health, Education and Welfare;

     (2)  A Representative from Faichuk Islands;

     (3)  A Representative from the Hall Islands, Namunwito Islands, and the Western Islands;

     (4)  A Representative from Namoneas Islands;

     (5)  A Representative from the Mortlocks Islands; and

     (6)  Three (3) duly appointed members of the Micronesian Health Coordinating Council representing Truk Chuuk State.

     § 1104.  Tenure of Board Members.
      Members of the Board shall serve by virtue of their positions as designated in Section 1103 of this act Chapter; provided that the members under subsection (2) through (5) of Section 1103, shall be appointed by the Governor with the advice and consent of the Legislature or an appropriate committee thereof and shall serve for three (3) years, subject to the removal or reappointment by the Governor with the advice and consent of the Legislature or an appropriate committee thereof.

     § 1105.  Compensation and Expenses.
     Members of the Board who are officials and employees of the State Government shall be entitled to administrative leave while on the business of the Board.  Members of the Board who no not receive regular salaries from the State Government while on the business of the Board shall receive twenty five dollars ($25.00) per day while on such business.  Members may receive reasonable and necessary expenses incurred in the discharge of their duties to the extent funds are made available.

     § 1106.  Organization and Meeting.
     The Board shall hold its first meeting within 30 thirty days of the effective date of this Act Chapter.  At the first meeting the Board shall elect from among its members a chairman who shall serve for a period of one year.  No member who has been elected chairman shall again be eligible to be elected chairman until one full term has intervened.  Board meetings shall be held at least once every two months and at such other times as may be designated by the chairman.  A quorum of the Board shall consist of five members.  The Board may establish by-laws as it deems necessary and consistent with this act Chapter.

     § 1107.  Duties and Functions.
     The Board shall have the following powers and responsibilities:

     (1)  To review plans, programs, projects, and policies of the State Department of Health Services and to recommend changes or alternatives consistent with the purpose of this act Chapter;

     (2)  To review budgets and budget requests and proposals for the State Department of Health Services, including all those pertaining to United States Congress grant funds, the Congress of the Federated States of Micronesia and Legislature, to recommend changes or alternatives consistent with the purposes of this act Chapter;

     (3)  To promote greater understanding and cooperation between providers and consumers of health care services, and to promote public health education to accomplish the same;

     (4)  To conduct public hearings and serve as a liaison between the State Department of Health Services and concerned persons and organizations;

     (5)  To submit findings and recommendations to the Governor, Legislature, and State Department of Health Services, including evaluation of health care services, upon its own initiative or upon request; and

     (6)  To perform such other functions consistent with the purposes of this act Chapter.

     § 1108.  Support.
     The officers and employees of the State Department of Health Services shall cooperate with the Board by furnishing such information as may be requested by the Board in connection with its powers and responsibilities.
