     § 1101.  Title.
     This Act Chapter may be known and cited as the "Chuuk State Scholarship Board Act of 1991."

Cross-reference:  The constitutional provisions on education are found in Art. X, Sections 1 to 5 of the Chuuk State Constitution.  Sections 1 to 5 state as follows:

     Section 1.  Free compulsory public elementary and free public secondary education shall be provided in the State of Chuuk as prescribed by statute.
     Section 2.  The State Government shall provide for the establishment, management, and support of a statewide system of public schools which shall, within the limits of its resources, provide an education of quality and relevancy, free from sectarian control and available to all persons in the State of Chuuk.
     Section 3.  There shall be a governing Board of Education, consisting of 8 members, with each member appointed by the Governor with the advice and consent of the Senate.  One of the members shall serve from each of the 5 Senatorial Regions, one from the public school system, one from the private system, and one who is known for knowledge and expertise in a field related to education.  The members of the Board shall serve staggered terms, as prescribed by statute.
     Section 4.  A head of the Education Department shall be appointed by the Governor with the advice and consent of the Senate from among 3 candidates nominated by the Board of Education.  The Board shall have the power, as prescribed by statute, to formulate policy and to exercise control over the public school system through the head of the Education Department.  The head of the Education Department shall serve as the executive director of the Board and may only be removed by the Board.
     Section 5.  The standard and conditions for the establishment of private schools shall be provided by law.  Assistance may be provided to parochial schools for non-religious purposes.

     § 1102.  Creation of Board; Composition; Terms.
     There is hereby established an autonomous Chuuk State Scholarship Board which shall consist of five members, one from each of the 5 five Chuuk State Senatorial regions, who shall be appointed by the Governor with the advice and consent of the senate.  All members of the Board shall serve for a term of three years.  The Board shall elect from among its members a Chairman, Vice-Chairman and a Secretary.  The Chairman shall ordinarily preside at meetings of the Board, or in his absence, the Vice-Chairman shall preside, or in the absence of both, the Secretary shall preside.  Members of the Board may be removed from the Board for incompetence, neglect of duty, or malfeasance in office by a three-fourth vote of all members of the Board.  The Governor, with the concurrence of the House of Representatives, may also remove members of the Board for incompetency, neglect of duty, or malfeasance in office.

     § 1103.  Duties and Functions.
     The Scholarship Board shall have the power to select qualified recipients to receive grants under this Act Chapter and other scholarship grants from any source, and shall exercise the following duties and responsibilities:

     (1)  To receive and review all applications for scholarship grants and determine the amount of the awards;

     (2)  To ensure that selection of awards is based on the following field of study priorities as determined by the Scholarship Board, which fields of study are limited to:

     (a)  Law;

     (b)  Medicine;

     (c)  Engineering;

     (d)  Business and Accounting;

     (e)  Marine Studies;

     (f)  Economics;

     (g)  Agricultural development;

     (h)  Education;

     (i)  Vocational education;

     (j)  Aviation; and

     (k)  Other fields of studies which the Scholarship Board deems necessary and important for manpower needs and development of the State as second priorities.

     (3)  To determine whether after a grant has been awarded, the recipient shall continue to receive the assistance grant in the amount necessary to complete the educational or vocational program for which the scholarship fund was awarded, or whether the assistance grant shall be discontinued in the event the recipient fails to maintain good standing in the program;

     (4)  To ensure that scholarships are awarded to those Chuukese students who graduated from high schools, both public and private, with commending academic records, displaying good behavior and manner, and showing serious efforts toward maintaining good academic achievement; and

     (5)  The Board shall have the power to promulgate written rules and regulations for the efficient implementation of this Act Chapter.

     § 1104.  Quorum and Meetings.

     (1)  A quorum of all regular and special meetings and business of the Scholarship Board shall be three members.  Regular and special meetings shall be called by the Chairman on his own initiative or be held at such time and in such place upon majority vote of the members of the Board.  The Student Services Coordinator shall keep full and accurate minutes of all meetings and actions of the Board, which shall be made available for public inspection;

     (2)  The State Student Services Coordinator shall provide administrative services to the Board and shall perform such duties and tasks as assigned by the Board.  He or the Acting Student Services Coordinator during his absence shall attend meetings of the Board, but has no voting right.

     § 1105.  Award and Payment of Financial Aid.
     The Scholarship Board shall award scholarship funds or loans in the field of study as the Scholarship Board may determine to be vital to the economic, social, and political development of the State of Chuuk.  The amount of awards or loans shall be determined by the Board in accordance with the need for manpower skills in the State, and the availability of financial resources, taking into consideration costs of tuition, books, materials, travel, room and board, academic performances, and other living expenses for a full-time student.  The Board shall determine the amount and method of repayment of sums awarded to said recipient if recipient fails to faithfully fulfill the sole purpose of the scholarship provided under this Act Chapter.

     § 1106.  Expenditures of Funds.
     The scholarship funds shall be expended in accordance with the appropriate law, the conditions of the Scholarship Fund, the State Financial Management Act, and relevant laws of the State.

     § 1107.  Severability.
     If any provision of this Act Chapter, or the application thereof, is held invalid, such holding shall not affect other provisions or applications, and to this end the provisions of this Act Chapter are severable.

     § 1108.  Office Staff.
     There is hereby created a Chuuk State Scholarship Board Office under management of the Board.  The Staff of the Student Services Office within the Department of Education are the staff of the State Scholarship Office, which includes the followings:

     (1)  Student Services Coordinator;

     (2)  Assistant Student Services Coordinator; and

     (3)  Secretary.

The functions, duties, rights, salaries and benefits of the Student Services Office within the Department of Education are hereby assumed by the Chuuk State Scholarship Office established by Section 1102 of this Act Chapter.  The Board may hire and may remove any employee thereof for good cause, and in accordance with the Public Services System Act.

     Section 10 .  Authorization and Appropriation.  The sum of $50,000 or so much thereof as may be necessary , is hereby authorized to be appropriated from the General Fund of the State for the Scholarship Office and the Board.  The amount authorized shall be appropriated in the fiscal year ending September 30, 1992.
