     § 1151.  Title.
     This Act Chapter may be cited as the "Chuuk State Building Code."

     § 1152.  Purpose.
     The purpose of this Act Chapter is to establish a building code of Chuuk which is acceptable to the United States Farmers Home Administration (hereinafter "FMHA" ), and which will consequently allow for the provision of low interest home loans by FHMA and the Chuuk Housing Authority, to the citizens of Chuuk.  The Building Code is intended to provide, as far as practicable, basic and uniform performance standards concerning the design, construction, quality of materials, use and occupancy, location and maintenance of building structures and equipment associated therewith that are funded or supported by the State or other government agencies.

     § 1153.  Definitions.
     Unless the context clearly indicates otherwise, the words and phrases used herein shall have the following meanings:

     (1)  "Building" means any structure of improvement, and its appurtenances, related facilities, and individual parts or systems that is are covered by this Act Chapter.

     (2)  "Building Officer" means a person appointed by the Governor from the Department of Planning and Statistics to administer and enforce the Building Code and any amendments and successors thereto.  The phrase shall also include any person designated in writing by the Building Officer to act on his behalf.

     (3)  "Owner" means any person or entity who intends to build, is building or has built any structure covered by this Act Chapter , or the owner's employees or agent.

     § 1154.  Application.

     (1)  This Act Chapter is applicable to the construction of all buildings and other structures, and the installation of appurtenances thereto, that are funded by the FMHA and supported with State funds.  This includes, except if waived or modified by the Building Officer, projects wherein the monies are administered or managed by the State and projects built with monies loaned by the State; provided, however, that when the monies for construction are made available to the State on condition that a different building standard shall apply, and such standard is more stringent or restrictive, then such alternate standard shall apply to the particular project.

     (2)  This Act Chapter may also apply to such other buildings or other structures to be constructed with funds from the National, or any foreign government or governmental agency, unless specifically modified or waived by the Building Officer.

     § 1155.  Building Permit; Application.

     (1)  Prior to the construction of any building covered by this Act Chapter, the owner shall apply for a building permit from the Building Officer.

     (2)  The permit application shall include any plans, designs, drawings, specifications or other information requested by the Building Officer relating to the construction of the building.

     § 1156.  Building Officer.
     The Governor shall appoint a Building Officer to administer and enforce the Building Code provided for in this Act Chapter.

     § 1157.  Housing Units; Single family residences.

     (1)  Building systems.  The building systems for the construction of single family residences and related facilities and improvements must comply with the Council of American Building Officials' One and Two Family Dwelling Code, 1986 edition including all state/ national amendments, but excluding Part I, except R-114, and also excluding part VII.

     (2)  Mechanical systems. The mechanical systems for the construction of single family residences and related facilities and improvements must comply with the Council of American Building Officials' One and Two Family Dwelling Code, 1986 edition including all state/ national amendments, but excluding Part I, except R-114, and also excluding part VII.

     (3)  Plumbing systems. The plumbing systems for the construction of single family residences and related facilities and improvements must comply with the Council of American Building Officials' One and Two Family Dwelling Code, 1986 edition including all state/ national amendments, but excluding Part I, except R-114, and also excluding part VII.

     (4)  Electrical systems.  The electrical systems for the construction of single family residences and related facilities and improvements must comply with the National Fire Protection Association's National Electrical Code for One and Two Family Dwellings, 1986 edition,  NFPA 70A, including all state/national amendments.

     § 1158.  Penalties for Violation.
     In addition to any other remedy or penalty available by law, any person having been served with an order of the Building Officer who fails to comply with such order within the time fixed by the Building Officer, and any owner, builder, architect, tenant, contractor, subcontractor, construction superintendent or their agents, or any other person taking part or assisting in the construction or use of any building who knowingly violates any of the applicable provisions of this Act Chapter shall, upon conviction, be subject to a fine of not more than five hundred dollars ($500.00), or thirty (30) days imprisonment, or both.  Each day of violation shall constitute a separate offense.
