§ 1301. Alcoholic Beverage Consumption Identification Card required.

No person in ~~Truk District~~ Chuuk State shall sell or give any alcoholic beverage to any other person unless the person to whom the alcoholic beverage is sold or given is then in immediate possession of a currently valid Alcoholic Beverage Consumption Identification Card, hereinafter referred to as an I.D. Card, issued to the bearer as provided in this ~~section~~ Chapter.

§ 1302. I.D. Card; Issuance.

(1) I.D. Cards shall be issued by the ~~District~~ State Chief of Police, or his designee, upon the submission of a completed written application in such form as shall be approved by the ~~District~~ State Alcohol Beverage Control Board, and upon his determination that the applicant meets all legal requirements to be entitled to an I.D. Card.

(2) The ~~District~~ State Alcohol Beverage Control Board is authorized to require by regulation such verifying evidence as it deems necessary to establish that applicants meet all legal requirements to be entitled to an I.D. Card.

§ 1303. I.D. Card; Application; False information.

No person shall give false information in obtaining or attempting to obtain an I.D. Card, nor shall any person in any way alter or deface a duly issued I.D. Card, nor shall any person allow any other person to use or possess his I.D. Card.

§ 1304. I.D. Card; Contents.

I.D. Cards shall bear not less than the following:

(1) Permittee's name;

(2) Permittee's permanent address;

(3) Permittee's place and date of birth;

(4) Permittee's height, weight, and color of hair and eyes;

(5) A recent photograph of the permitee (for "Regular" I.D. Cards only);

(6) Permittee's signature;

(7) An I.D. Card number;

(8) Issue and expiration date of the I.D. Card; and

(9) Signature of the ~~District~~ State Chief of Police.

§ 1305. I.D. Card; Types.

I.D. Cards shall be of two types, "Regular," valid for one calendar year from the date of issue, and "Temporary," valid for 30 days from date of issue. The issuance fee for Regular I.D. Cards shall be $6.00, and the issuance fee for Temporary I.D. Cards shall be $3.00. The issuance fee for duplicates of lost or destroyed I.D. Cards shall be $2.50.

§ 1306. I.D. Card; Issuance fees procedures.

All issuance fees for I.D. Cards shall be collected, accounted for, and disbursed as follows:

~~(a)~~ (1) The ~~District~~ State Chief of Police, or his designee, shall collect the prescribed fee for the issuance of all I.D. Cards in cash, at the time of issuance, and no I.D. Card shall be issued prior to collection of the issuance fee therefore.

~~(b)~~ (2) The ~~District~~ State Chief of Police shall maintain a separate ledger or ledgers in which shall be recorded all fees collected, along with a notation of the type of I.D. Card issued, the date issued, the date of expiration, the I.D. Card number, and the name of the person to whom issued.

~~(c)~~ (3) All fees collected shall be turned over to the ~~Truk District Treasurer~~ State Director of the Treasury by the Chief of Police not less than biweekly and shall be paid into the General Fund of ~~the Truk District Legislature~~ Chuuk State.

§ 1307. I.D. Card; Denial and revocation.

Issuance of an I.D. Card shall be refused, or if already issued, such I.D. Card shall be revoked by order of the Alcoholic Beverage Control Board as to any person who:

~~(a)~~ (1) Is under the age of 21 18 years;

~~(b)~~ (2) Has been acquitted of any criminal charge by reason of insanity;

~~(c)~~ (3) Has been adjudicated mentally incompetent;

~~(d)~~ (4) Has been admitted as a patient in a hospital for drug addiction or alcoholism;

~~(e)~~ (5) Has been convicted, whether by plea of guilty or after trial, of any criminal offense involving actual or attempted personal injury or death;

~~(f)~~ (6) Has misrepresented a material fact on his application to obtain or renew an I.D. Card; or

~~(g)~~ (7) Has violated any provision of this ~~section or any other section of~~ Chapter ~~1 of Title 3 of the Truk District Code~~ or any duly issued regulation of the ~~District~~ Alcoholic Beverage Control Board.

§ 1308. I.D. Card; Penalty.

Any person who purchases, is in possession of, or has consumed any alcoholic beverage not then having in his immediate possession a currently valid Alcoholic Beverage Consumption I.D. Card, and any person who violates ~~any provision of subsection (1) or (2) of this~~ Sections 1301 or 1303 shall be guilty of a misdemeanor and, and upon conviction thereof, shall be fined not more than $100.00 or imprisoned for not more than six (6) months or both.

§ 1309. I.D. Card; Religious institutions.

Nothing in ~~this Section~~ Chapter shall in any way limit or restrict the sale of sacramental wine to bona fide religious denominations for use in religious services.

§ 1310. I.D. Card; Annual appropriation.

There is hereby authorized ~~out of the General Fund of the Truk District Legislature~~ an annual appropriation of such funds as the Legislature may determine from time to time are necessary for the operation of the alcoholic beverage control program established ~~under this Act~~ in this Chapter. The ~~District~~ State Chief of Police, with the approval of the State ~~District~~ Alcoholic Beverage Control Board, shall administer the funds appropriated under this ~~Act~~ Section and shall purchase such supplies and equipment as are necessary to begin operation as required ~~under this Act~~ by this Chapter.
